Terms and Conditions

  1. The Promoter of this Competition is Mecon Insurance Pty Ltd (ABN: 29 059 310 904) of Level 5, 50 Margaret Street, Sydney, NSW 2000 (the ‘Promoter’). Information on how to enter the Competition and a description of the Prize form part of these terms and conditions of entry.  Entry into the Competition is deemed acceptance of these terms and conditions of entry and the Participant agrees to be bound by these terms and conditions of entry.
  2. Entry is restricted to Australian and New Zealand new and existing registered brokers, including the broker’s employees aged 18 years and over, who have a current and executed broker agreement with the Promoter (‘Participants’). To enter the Competition and be eligible to win, Participants must during the period 12:00am (AEST) 1 April 2017 to 11:59pm (AEST) 31 March 2018 (the ‘Period’):
    Arrange a new business or renewal contract of insurance to be issued by the Promoter with an inception date during the Period, subject to Clause 3 below; and
    • Ensure full payment for the contract of insurance is remitted to the Promoter in accordance with credit terms, ‘Valid Entry’.
  3. The entry to the Competition is not a Valid Entry if the contract of insurance is cancelled or lapsed for any reason during the period of insurance.
  4. The Competition is not open to employees of or contractors to the Promoter, including spouses, parents and children of such employees and contractors.
  5. The Competition commences on Saturday 1 April 2017 at 12:00am (AEST) and concludes on Saturday 31 March 2018 at 11:59pm (AEST). There is no limitation on the number of Valid Entries for the Competition. There will be one Major Prize and 9 Minor Prizes issued for the Competition.
  6. By entering the Competition, Participants agree to the Promoter using details provided for entry into the Competition to update its database for communication, marketing and promotional purposes including the use of mobile telephone numbers.   7. The Promoter reserves the right to request the winners to provide proof of identity age and place of residence, and to disqualify any Participant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this Competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  8. The Competition does not involve a round where a Participant will be eliminated
  9. Prizes and Prize Draws:
    Minor Prizes: Nine (9) prizes of vouchers from Rebel Sport, Woolworths or Westfield, each valued at $250 (Minor Prize).
    ii.
    The prize draws for the Minor Prizes of the Competition are to be held at approximately 11:00am (AEST) on the first Monday of each month for a 9-month period commencing on Monday 3 July 2017, unless a public holiday in which case it will take place on the next business day in Sydney, at 103/56 Bowman Street, Pyrmont, 2009. One (1) of the 9 Minor Prizes will be awarded at each monthly draw. The prize winner for the Minor Prize will be electronically selected at random from a computer-generated listing of Valid Entries received from the commencement of the Competition up until 11:59pm (AEST) the day prior to the draw. The first valid entry drawn will be the winner of the prize. The Prize winner will be notified by telephone and email. The Minor Prize will be sent to the winner by post. The Promoter takes no responsibility if the details provided by the prize winner are incorrect or if the prize winner cannot be contacted.
    iii. If the prize winner wishes to claim the Minor Prize, the prize winner must confirm to the Promoter that they wish to do so within three (3) months from the draw date. If the prize winner fails to claim the Minor Prize by this time, the prize winner will be deemed to have forfeited the prize.
    iv. In the event that the prize winner forfeits the Minor Prize or the Minor Prize remains unclaimed after three (3) months from the draw date, the Promoter will conduct a redraw, following the same procedure as the original draw. The redraw will take place at approximately 11.00 am three (3) months and one (1) day following the original draw, at the same place as the original draw. The prize winner from any redraw will be notified as per the procedure at 9(a)(i) above. In the event that this redrawn Minor Prize winner is not eligible, the Promoter will conduct a redraw until the Minor Prize is awarded (subject to any further regulatory directions).
    i. Major Prize: There will be one (1) Major Prize awarded in this Competition. The Major Prize is comprised of the following:
    • Return Economy class flights from the prize winner’s nearest Australian State capital city or New Zealand major city, to New York (United States of America), including checked luggage and taxes – for two (2) people. Airline and tickets to be selected and booked by the Promoter, or an agent appointed by the Promoter, at the Promoter’s absolute discretion.
    • Return private airport transfers from the designated airport to the designated accommodation – for two (2) people.
    • Six (6) nights at a four (4) star hotel accommodation in Manhattan, New York City, New York (United States of America).
    • AUD$2,000 spending money.
    • AUD$500 meal in top New York Restaurant
    The total value of the Major Prize to be awarded in this Competition is AUD $15,650 (GST exempt) as at 27 February 2017 (Major Prize).
    ii. Spending money (other than specified above at 9(b)(i)), meals (other than specified above at 9(b)(i)), taxes, insurance (including any applicable insurance excesses), transfers and transport to and from airports or accommodation (other than specified above at 9(b)(i)), items of a personal nature, in-room charges, all other ancillary and any other costs are not included unless specified at 9(b)(i).
    iii. All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel is valid until 30 July 2019 unless otherwise stated for set dates of travel. Block out periods could apply and includes all Australian school and public holidays along with all other special event periods, unless otherwise stated for set dates. All bookings must be made a minimum of 45 days in advance of requested departure dates. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of individual prize and service providers, including those as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. The prize winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. The prize winner and their companion must have valid travel insurance for their period of travel.
    iv. It is the prize winner’s, and their companion’s, personal responsibility to ensure that they have valid documentation, including but not limited to valid passports, visas, and health requirements, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the prize winner and their companion. The prize winner and their companion will be responsible for all costs in obtaining the relevant and required travel documentation.
    v. During the entire duration of the Major Prize, a nominated parent or legal guardian must accompany any person under 18 years of age. The prize winner (and their companion) must depart from and return to the same departure point and travel together. Exact venue accommodation provided for will be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The prize winner (or their companion) may be required to present their credit card at the time of accommodation check-in. Spending money may be awarded in the form of a cheque made payable in the prize winner’s name or via an electronic funds transfer into the prize winner’s nominated bank account, as determined by the Promoter.
    vi. The prize draw for the Major Prize of the Competition will be held at approximately 11:00am (AEST) on 2 July 2018 at 103/56 Bowman Street, Pyrmont, 2009.  The prize winner will be electronically selected at random from a computer-generated listing of Valid Entries received during the Period. The first valid entry drawn will be the winner of the Major Prize.
The Major Prize winner will be notified by telephone and email. The name of the prize winner will also be published in The Australian newspaper on 6 July 2018. The Promoter takes no responsibility if the details provided by the prize winner are incorrect or if the prize winner cannot be contacted.
    vii. If the prize winner wishes to claim the Major Prize, the prize winner must confirm to the Promoter that they wish to do so within three (3) months from the draw date. If the prize winner fails to claim the Major Prize by this time, the prize winner will be deemed to have forfeited the prize.
    viii. In the event that the prize winner forfeits the Major Prize or the Major Prize remains unclaimed after thee (3) months from the draw date, the Promoter will conduct a redraw, following the same procedure as the original draw. The redraw will take place at approximately 11.00 am three (3) months and one (1) day following the original draw, at the same place as the original draw. The prize winner from any redraw will be notified as per the procedure at 9(b)(vi) above. In the event that this redrawn Major Prize winner is not eligible, the Promoter will conduct a redraw until the Major Prize is awarded (subject to any further regulatory directions).
  10. The Major Prize and Minor Prizes must be taken as offered and cannot be varied, transferred, exchanged or taken as cash (excluding any cash components of the prize as specified at 9(a) and 9(b) above). In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into. In the event that any prize (or part of any prize) is unavailable for any reason at any time, subject to legislation and any written directions from a regulatory authority the Promoter reserves the right to substitute that prize (or that part of the prize) with another prize of equal or greater value and the relevant prize winner will be notified accordingly.
  11. The Promoter’s decision in relation to any aspect of the Competition is final and binding on every Participant who enters and no correspondence will be entered into.
  12. The Major Prize and Minor Prize values are specified at 9(a) and 9(b) above and the Promoter takes no responsibility for any variation in item values. Any taxes which may be payable as a consequence of a winner receiving a prize are the sole responsibility of the prize winner. Participants should seek independent financial advice in this regard.
  13. All Participants agree to the use of their name and any photograph/s for marketing, publicity and promotional purposes for an indefinite period, without compensation, and agree that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
  14. To the fullest extent permissible by law, each Participant in the Competition and the prize winners and their companion, where applicable, each releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by them in connection with the prize or their participation in the Competition. The Promoter, its related bodies corporate, officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential or economic loss) suffered or sustained by a Participant, the prize winners or their companion in connection with this Competition, the promotion of this Competition, or the use of or participation in any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to a Participant’s or any other person’s computer related to or resulting from participation in or down-loading any materials related to this Competition. The use of any automated entry software or any other mechanical or electronic means that allows a Participant to automatically enter into the Competition repeatedly is prohibited and will render all entries submitted by that Participant invalid.
  15. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a prize winner or a Participant; or (f) use of or participation in any prize.
  16. As a condition of accepting the prize, the prize winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event the prize winner’s companion is under the age of 18, a nominated parent / legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
